Abstract

ملخص:

تُعد جريمة استغلال النفوذ من الجرائم الخطيرة، فبالإضافة إلى كونها تؤدي إلى المساس بمبادئ دستورية من قبيل مساواة المواطنين أمام القانون وأمام المرافق العامة، فإنها تؤدي أيضاً إلى انعدام الثقة بين المواطن وجهات الإدارة عبر إبرازها بمظهر الخاضع لبعض أصحاب النفوذ والمتسلطين .

ونظراً لخطورة هذه الجريمة على كيان الدولة ككل ومدى نجاعتها في تقديم خدماتها ، أو تحصيل الاعباء من المواطنين على قدم المساواة اهتمت التشريعات بتجريم هذا السلوك وتشديد العقوبات عليه في سبيل ردعه، وهو ما أخذ به المشرعان الفلسطيني والجزائري .

Abstract:

The influence peddling is considered as one of the most serious crimes. Besides prejudicing the constitutional principles, it also devouring the equality among civilians in front of the law and the public utilities. In addition, it promotes distrust between the civilians and the administrative bodies as it shows the administration subjects to the influential people and rulers.

Due to the seriousness of this crime on the structure of the state as a whole and its effectiveness in offering its services or in collecting burdens of the citizens on an equal footing, the legislation focused on criminalizing this behavior and increased the penalties in order to deter it. Such procedure has been applied by both the Palestinian and the Algerian legislators.
