القواعد الفقهية والأصولية المتعلقة بأحكام عضل المرأة عن النكاح

Abstract

الملخص:

يؤصل هذا البحث لأحكام عضل المرأة من خلال القواعد الفقهية والأصولية المنظمة لهذا الشأن، حيث بدأ الباحث ببيان معنى العضل لغة واصطلاحاً، ثم بين أسبابه، وآثاره، ثم التعريج على أشهر القواعد الفقهية والأصولية التي تتعلق فروعها بأحكام العضل، فبين معنى القاعدة، وذكر أصلها، ثم ربط فروع كل قاعدة بأصلها مما له علاقة بأحكام العضل.

وقد توصل الباحث من خلال البحث إلى جملة من النتائج منها: أنه لا يعتبر الولي عاضلاً لموليته إلا إذا قصد الإضرار بها، فإن منعها الزواج لمصلحة شرعية معتبرة فلا يتناوله التحريم.

Abstract

This research stabilizes to the woman's prevention of marriages provisions through the jurris prudence and fundamental rules that organizes this issue . the two researcher start with the definition of marriage prevention. Then, he identify its causes and effects. After that, he declare the most famous jurrisprudence and fundamental rules which relate to the provisions of marriage prevention .

Researcher mention its base, then they join each rule with its base related to the provisions of woman's marriage preventions.

Finally, the researcher come to a set of results and recommendations that the guardian isn’t considered a marriage preventer unless he intends to harm the woman under his tutelage. But if he prevents her from marriage in favor of a legal interest, then it isn’t covered by prohibitions.
