Abstract

This paper is a comparative study of war rules in both Islamic and International laws. The meaning of war in language and law is verified. The concept of "Jihad", its maening, objectives and status or position is throughly invistigated. Furthermore, rules pertaining to civilians(women, monks, sick persons, or any other person in their positions ) are extensively discussed.

Besides that, the position of Islamic and International law with regard to: manipulation of people as shields during military confrontation, buring soldeirs, mutilating bodeis, cutting trees, killing animals, damaging natural resources and properteis, distroying infrastructure, houses, and institution, threatening diplomats and ambassadores, assassinating peaple on political grounds has been highlighted. Finally, types, uses and dangers of weapons of mass distruction have been covered in this study. Real cases or exampels are demonstrated to show and support how International rules and treaties that govern war laws have been violated and ignored by enemies.
