Abstract

Making contracts via electronic channels, e.g. email communication, is an important aspect of the present technological revolution in our time. In this study, I discussed and analyzed several pertinent themes, including the “electronic signature,” its forms and functions in comparison with the conveventional signatures. This is done in light of Palestinian legislations regardieing electronic dealings, particularly the draft Palestinian law on electronic exchange and trade. The conclusion I reached is that the electronic signateture performs the same function performed by the conventional signature, although the safety margin may vary in both cases. Hence, one can safely

say that the electronic signature encapsulates a minimal degree of safety and reliability, very much as the traditional signature does. Finally, I adopted the descriptive and analytical methodology in this study. I also compared and contrasted a number of electronic dealings which helped me reach the conceclusions I have reached.
