Abstract

This research deals with an important jurisprudence subject, entitled: “crimes in place of difference in being the responsibility of the clan in Islamic jurisprudence - a comparative study.” It consisted of an introduction, seven topics and a conclusion. The introduction was devoted to demonstrate the meaning of crime and its types, and the clan and what it bears responsibility for. Then came the other six topics to review the crimes in place of difference in being the responsibility of the clan.The first topic was devoted to the deliberate crime in which there is no punishment, the second to the deliberate crime of minors and the insane, the third to quasi-deliberate crime, the fourth error for the imam, the fifth to man’s wrongly committing a crime against

himself, the sixth to the crime committed against the slave ; and the seventh was a statement of the amount the clan should pay due to the fact that it is her duty.Finally, the conclusion summarized the most important results, in addition to the recommendations.
