Abstract

The study sheds light on the determinants of jurisprudential controls regulating the jurisprudence of Tahara (purity) and Salah (prayer), due to its importance that lies in its connection dealing with a general matter aimed at the correctness of legitimate costs, intending to indicate the determinants of the jurisprudence governing the jurisprudence of purity and prayer, and the impact of these provisions on worship correctly and invalid in the light of the study of the Shafi'i doctrine. The study found that the determinants of jurisprudential controls differ in view of each control, so those who have no control in Sharia or language must resort to custom.

سلَّطت الدراسة الضوء على محددات الضوابط الفقهية الناظمة لفقه الطهارة والصَّلاة؛ نظراً لأهميته التي تكمن في متعلقه، حيث يعالج أمراً عاماً غايته استقامة التكاليف الشرعية، هادفاً لبيان محددات الضوابط الفقهية الناظمة لفقه الطهارة والصَّلاة، وأثر هذه الأحكام على العبادة صحةً وبطلاناً في ضوء دراسة المذهب الشافعي.

حيث خلصت الدراسة إلى اختلاف محددات الضوابط الفقهية بالنظر لذات الضابط، فما لا ضابط له في الشرع ولا في اللغة يرجع فيه إلى العرف.
