Abstract
Judicial notification by electronic means is considered one of the litigation procedures that contribute to the speed and simplification of the judicial process. The Jordanian legislator has dealt with the provisions of this form of judicial notification in the system for the use of electronic means in civil judicial procedures No. (95) of 2018, and this system has been applied to avoid the effects of the Coronavirus (Covid19) and the issuance of Defense Order No. (21) which imposed dealing with some picture. In view of the recentness of the Jordanian judicial experience in terms of using electronic means in the field of judicial notification, we sought in this research to study the general provisions that frame such notification, by explaining its concept and justifications that encourage its adoption and developing its provisions, and the electronic means used in it, in addition to Addressing the legal procedures upon which electronic judicial notification is based, and the legal implications that it has in terms of authenticity. Based on that, we came to some conclusions and observations that could establish a number of proposals that we hope the Jordanian legislator will take in the context of his endeavor to simplify litigation procedures and reduce the costs and time caused by the introduction of the traditional judicial notification.
