Abstract
The study aimed to define the concept of the divorce of the drunk which means the termination of marriage contract by the utterance of divorce produced by the drunken husband. The study presented the different faqihs’ opinions, displayed their proofs, discussed them, and concluded with the predominant opinion that the divorce does not take place in reality if the husband was drunk. The study compared that conclusion with the new Jordan Personal Status Law number (36) for year 2010 which claims that the drunk’s utterance of divorce does not terminate marriage contract.
