Abstract

This paper discusses the ruling of wife’s giving in Islamic Jurisprudence indicating the ruling of wife’s giving her own money as well as the ruling of giving her husband's money. The paper views scholars' points of view in these two cases and their evidence , in addition to discussing their points and giving preference to the most acceptable one.

According to the right sayings, both the general and the specific , the implicit and the explicit, in these two situations, the paper has found that a wife has the right to give her money completely without a permission from her husband, where as she has to give her husband's money without his permission only if it was a little.

The study recommends the constructors of the Jordanian Civil Law and the Jordanian Personal Status Law to put into consideration the findings that this paper has found.
