Abstract
This study aims to reveal the impact of the pure overcharge (alghaben) free of delude (gharar) on the contract binding for both contractors, in Islamic jurisprudence (feqh) and civil law, by reveling the meaning of pure overcharge (alghaben), and its forms, and the stand of the Islamic jurisprudence and civil law scholars towards the rightness of option to the overcharged person, then discussing their views and their proofs, and surpass between them, and clarifying the conditions and controls that should be available to confirm the option in pure overcharge (alghaben).
