Abstract

ملخص

تناول البحث قاعدة "تبدل المِلك كتبدل العين" عند الحنفية، وقد ظهر من خلال البحث أصل للقاعدة من السنة والقياس والمعقول، والعديد من التطبيقات الفقهية في مختلف أبواب المعاملات، وأنها تختص بالتبدل الحكمي للعين لا الحقيقي، الأمر الذي أسهم في حل الكثير من قضايا المعاملات في المذهب الحنفي.

The rule that changing the property as changing the oppointed thing according to Hanafi school

Abstract

The research dealt with the rule (switching properties like the same thing) by the scholars of the Hanafi school of thought.

And some exceptions, and it is concerned with the change in the provisions of things and not in the form of real things, and this contributed a lot in solving many issues of transactions in the Hanafi school.
