Abstract

ملخص

يُعدُّ عقد الرهن من العقود التبعية، حيث لا يراد لذاته، وإنما يكون تابعا للعقد الذي جاء لضمانه، ويضطلع عقد الرهن بدور بارز ومحوري في تحقيق ما يعرف بالأمن العقدي، من خلال توفير طمأنينة للعاقدين في العقود التي يشرع عقد الرهن لتوثيقها، بما يوفره من قدرة على الاستيثاق وحفظ الحقوق.

وتهدف هذه الدراسة إلى بيان الحقوق التي يمنحها هذا العقد، والالتزامات التي يرتبها على أحد طرفيه وهو المرتهن، وصولا إلى الخاتمة التي أودعت فيها أهم النتائج والتوصيات، التي خلصت إليها هذه الدراسة.

The rights and obligations of the Islamic mortgagee between jurisprudence and Jordanian law

Abstract

The mortgage contract is considered a subordinate contract, as it is not intended for its own sake, but rather as a subordinate to the contract that came to guarantee it. To trust and preserve rights.

This study aims to clarify the rights granted by this contract, and the obligations it entails on one of the parties, the mortgagee, to the conclusion where the most important conclusions and recommendations of this study were deposited.
