Abstract

ملخص

يتناول البحث موضوع إدارة مخاطر السّعر المرجعيّ باستخدام أداة محدّدة من أدوات إدارة المخاطر، ألا وهي "التّورّق المدار".

ويهدف البحث إلى الخروج بتصور شامل للموضوع، وذلك من خلال التّعرف على حقيقة مخاطر السّعر المرجعيّ وحكم إدارتها، والتّعرف على التّورّق المدار كأداة لإدارة هذه المخاطر، عبر بيان حقيقتها وآلية تطبيقها وحكمها الشرعيّ.

وقد خلص البحث إلى عدد من النتائج أبرزها: عدم اعتبار التورق المدار أداة أو استراتيجيّة ناجحة لإدارة المخاطر؛ وذلك لأن الهدف منها ربط الربح بسعر الفائدة بحيث يصبح متغيّراً بتغيّره، ولما تشتمل عليه من شبهات شرعيّة أهمها: أن الهيكليّة التي تقوم عليها هي صورة من صور قلب الدّين، يتم التوصل إليها من خلال عمليات تورّق منظّم صوريّة وشكليّة لا يترتب عليها أي مبادلات فعليّة.

Managing reference rate risks in Islamic Financing through “Managed Tawarroq”

Abstract

This paper studied the usage of “Managed Tawaruq” as a tool for managing risks of margin changes in the Islamic Financing.

The study has concluded that this tool cannot be considered as a Sharia Compliant tool for managing risks for a number of reasons, the most important ones are that goal of this tool is to directly link the price margin with the interest rates, and because it solely depends on intermediate transactions that are not intended for their own with no actual exchange of real goods.
