Abstract

ملخص

تتحدث هذه الدراسة عن مسألة مهمة، وهي تنازل الأخوات عن التركة، ونهدف الدراسة إلى معرفة التكيف الفقهي لهذا التصرف، والأثر المترتب عليه، وبيان أثر الحياء والعادات على هذا التصرف، وبيان الشروط اللازمة ليكون هذا التنازل صحيحا.

ومن أهم النتائج التي توصلت إليها الدراسة، جواز تراخي القبول بالتنازل ما لم تتراجع المتنازلة، عدم صحة التنازل إذا كان صادرا بسيف الحياء أو العادات أو التقاليد، لا يصح التنازل مع جهالة القدر المتنازل عنه أو قيمته، لا يتم التنازل إلا بعد قبض المتنازل عنه من المتنازل لهم.

Abstract This study is about an important issue related to sisters giving up the inheritance. The study aims to know the Fiqh adaptation of this behavior and its implications Also. showing the effect of shyness and customs on behavior. And clarifying the conditions necessary for this waiver to be correct. Among the most important results of the study is the permissibility of lax acceptance of a waiver unless the sister recedes, the invalidity of the waiver in case of shyness, customs or traditions The assignment is not valid with the ignorance value of the inheritance amount, and the brothers do not own their sister's share of the estate until they take it.
