Abstract

ملخص

يتناول الباحث مسألة تسعير الخدمات الصحية للمصابين بفيروس كورونا المستجد (COVID-19) كأحد مستتبعات جائحة انتشار فيروس كورونا (COVID-19) ويهدف إلى تقديم الحلول الشرعية، والمعالجات المناسبة لإشكالية ارتفاع أسعار الخدمات الصحية المقدمة للمصابين بفيروس كورونا المستجد (COVID-19) من قبل المستشفيات الخاصة، والقضاء على استغلال أوقات الأزمات والأوبئة، مبرزاً سعة الفقه الإسلامي، وشموله، واستيعابه لكافة الظروف والنوازل.

وخلص الباحث: إلى جواز التسعير من قبل ولي الأمر أو من ينيبه جمعاً بين الأدلة، وسداً للحاجة، وإقامة للعدل، وتحقيقاً للمصلحة العامة، وتطبيقاً للقاعدة الشرعية (تصرف الإمام على الرعية منوط بالمصلحة)، ويوصي الباحث بأن يكون تسعير الخدمات الصحية تسعير عدل، لا وكس فيه، ولا شطط يراعي مصلحة جميع الأطراف.

Pricing of Health Services to COVID-19 Infected Persons: An Applied Juristic Study

Abstract

The researcher deals with the question of pricing of health services rendered to COVID-19 infected persons as one of the consequences of COVID-19 pandemic, and aims at finding legal solutions and proper remedies for the problem of rise in the prices of health services rendered to COVID-19 infected persons by private hospitals and to fight cashing on crises and epidemics, highlighting the vastness of the Islamic jurisprudence, its inclusiveness and absorption of all circumstances and crises.

The researcher concludes to the legality of pricing by the ruler or his delegate, by collectivity of evidences, to satisfy need, constitute fairness, attain public interest and apply

Sharia rule (The action of the ruler on his subjects is for interest). He recommends that pricing of health services must be fair, without any excessiveness and observing the interest of all parties.
