Abstract

The research examines the balancing between benefits and harms, and its applications to some financial transactions related to the Corona pandemic. This is achieved by explaining the reality of the benefits and harms, and the rules of weighting between them in the event of conflict, and then addressing some of their applications related to the Corona pandemic in the field of financial transactions, such as monopoly, pricing, closing markets, and how the benefits and harms are balanced in judging them. The research adopted the descriptive and analytical method, presenting scientific material and jurisprudential applications, in addition to defining and analyzing them. Among the most prominent findings of the research is the importance of careful consideration and balanced jurisprudence between benefits and harms when judging the calamities of the Corona pandemic, especially those related to financial transactions.

يتناول البحث دراسة موضوع الموازنة بين المصالح والمفاسد وتطبيقاته على بعض المعاملات المالية المتعلقة بجائحة كورونا؛ وذلك ببيان حقيقة المصالح والمفاسد، وقواعد الترجيح بينها عند التعارض، ومن ثمَّ معالجة لبعض تطبيقاته المتعلقة بجائحة كورونا في باب المعاملات المالية؛ كالاحتكار، والتسعير، وإغلاق الأسواق، وكيفية الموازنة بين المصالح والمفاسد في الحكم عليها، والاجتهاد فيها.

وقد كان منهج البحث وصفيًا تحليليًا يعرض المادة العلمية والتطبيقات الفقهية، ويعرّف بها ويحللها، ومن أبرز ما توصل إليه البحث أهمية النظر الدقيق والاجتهاد المتوازن بين المصالح والمفاسد عند الحكم على نوازل جائحة كورونا، وخاصة المتعلقة بباب المعاملات المالية.
