حقيقة الاستحسان عند الحنفية The Reality of the Istihsan According to Al Hanafia School

Abstract

Al Hanafia School used the Istihsan principle until they became famous for it, where Abu Hanifa was incomparable with it. Istihsan in all its forms is nothing but an alteration of a general rule, texts, an analogy, or an extracted origin for legal evidence that requires modification. This act of Istihsan was not an opinion, preference, self-distance, or derogation of legal evidence, rather the Istihsan was based on evidence that may be a hidden analogy, text, consensus, necessity, custom, interest, or a general jurisprudential rule.

لقد أعمل الحنفية الاستحسان حتى اشتهروا به وكان أبو حنيفة فيه لا يجارى، وأن الاستحسان بكل أنواعه ما هو إلا عدول عن قاعدة عامة، أو عموم نص، أو علة قياس، أو أصل مستنبط، لدليل شرعي يقتضي هذا العدول. ولم يكن العمل بالاستحسان قولا بالرأي أو الهوى والتشهي أو خروجا عن الأدلة الشرعية، بل إن الاستحسان كان يستند إلى دليل قد يكون قياسا خفيا أو نصا أو إجماعا أو ضرورة، أو عرفاً أو مصلحة أو قاعدة فقهية عامة.
