Holding the Promise of Preference in Light of Islamic Jurisprudence and Jordanian Civil Law (A Comparative Study)

Abstract

This study aims to clarify the promise contract of preference, which is one of the new contracts in civil laws. Where his idea is based on an agreement whereby one of the parties is committed to the other not to conclude a specific contract with others except after he has proposed to the other party to conclude it with him, and therefore the study aimed to clarify it in terms of its concept and characteristics, and the jurisprudential rulings related to it in the light of Islamic Sharia.

The researchers concluded that making the promise of preference is attached to the chapter on the binding promise from one side, which is what has been established in the jurisprudence councils, Sharia committees and Islamic accounting companies, and that it is applied to the obligation of religion, even if there is a difference in the judiciary.
