Abstract
This study aims at clarifying the role of the Palestinian legislator in providing guarantees concerning the worker's wages through specifying the definition of the wages as well as the items that are of relation to it in the Palestinian Law. In the first part of this study, the researchers attempted to define the wages and what they are comprised of in order to provide protection over the wages and their components. The study discussed whether or not the extra work can be considered a part of the workers' wages, and it covered the concept of the minimum wage and the efficiency of the legal texts that define and modify this concept based on the economic developments. It also talked about the Palestinians' legislator's social view regarding the wages so as to guarantee that the wages meet the needs of the workers and their families. The study, moreover, covered the workers' claim of a wage without having done an actual work. It also discussed the rule of non-discrimination in wages between men and women. However, the Palestinian legislation failed to regulate the different aspects of this topic. This study, therefore, attempted to point out the deficiencies in Palestinian law, guided by other laws that regulated this topic. It also raised the topic of the worker's right to claim wages during the vocational training period, which was not addressed by the Palestinian legislator. Comparative laws, especially the French legislation, were searched for the rules that gave the worker the right to receive a wage during the training period. The research examined the role of labor inspectors in monitoring employers' respect for wage rules, in addition to the extent to which legal protection was provided during collective negotiations.
