Abstract

This study aimed to shed light on the legal aspects of the crime of real estate usurpation as defined in Article 448 of the Jordanian Penal Code No. 16 of the year 1960, by analyzing the elements of the crime and reviewing the associated punishments and aggravating circumstances, as well as outlining the procedures for criminal prosecution of this crime. Employing a descriptive and analytical legal research methodology, the study compares Lebanese and Egyptian laws and emphasizes the importance of following the stance of the Jordanian judiciary throughout all areas of research. The research concluded with several findings and recommendations that the researcher deems necessary to enhance the criminal protection of property.
