Abstract
This study presents the sayings and actions of our Prophet, peace be upon him, regarding the penal system, which remains a guiding light across all times for those seeking peace, security, and stability. The study aims to answer several questions related to the general principles followed by the Prophet’s Sunnah in dealing with threats to civil peace, including how it addressed crimes before, during, and after their occurrence, as well as the precautions taken to prevent the improper application of the penal system. First, I explain the concept of search terminology, then discussed the meanings of the Sunnah, civil peace, and penalties. Second, I explore the methodology of the Prophet’s Sunnah in dealing with threats to civil peace through the penal system. This included an overview of the general rules in education and promoting societal righteousness. Third, I focus on blocking every pretext for crimes that threaten civil peace. I also illustrate many of the penal provisions and the conditions for proving and establishing them. Forth, I discuss the implementation of justice in Sharia punishments, and emphasize the Prophet’s Sunnah’s keenness on preventing the wrongful application of the penal system. Finally, I include the results of the research and its recommendations. The results reveal that the penal system in Islam aims to preserve the five necessities of life and seeks to protect society from crime. Its goal is to correct behavior and remedy the effects of sin. The Prophet’s Sunnah in maintaining civil peace is based firstly on general principles of education and ensuring the well-being of society, closing all pretexts for crimes that threaten civil peace. It also clarified many of the rulings related to punishments, along with their conditions for proof and implementation.
