Abstract

هدفت الدِّراسة إلى الوقوف على واقع البلديات الأردنية بين تطبيق مفهوم الإدارة المحلية وتطلعات الحكم المحلي في ظل قانون الإدارة المحلية لسنة 2021، ولغايات تحقيق الهدف من الدِّراسة تمَّ اتِّباع المنهج الوصفي التحليلي، والمنهج القانوني، توصلت الدِّراسة إلى عددٍ من النتائج، أبرزها: إنَّ البلديات من هيئات الإدارة المحلية التي تتبع أسلوب اللامركزية الإدارية لتنظيم المناطق التابعة لها وتقديم الخدمات لها هو ما أكد عليه قانون الإدارة المحلية الأردني رقم (22) لسنة 2021، وعلى الرغم من أنَّ قانون الإدارة المحلية الأردني لعام 2021 قد تضمَّن العديـد مـن الجوانب الإيجابية المتعلقة بتوسيع صلاحيات المجالس البلدية، إلَّا أنَّ القانون ضمَّ عدداً من الجوانب والمحددات لإحداث نقلة نوعية على نحو تطبيق مفهوم الحكم المحلي، خاصة في بعض الجوانب القانونية والإدارية والمالية. وقد قدمت الدِّراسة عدداً من التوصيات لتعزيز دور البلديات في التَّوجه نحو تطبيق نظام الحكم المحلي مستقبلاً، من أبرزها: إجراء تعديلات جوهرية في نصوص قانون الإدارة المحلية الحالي، من خلال إيجاد علاقة أكثـر توازانـاً بـين السـلطتين المركزية والمحلية، تحدُّ من سيطرة السّلطة المركزية وتحكمها بعمل المجالس البلدية خاصة في الجوانب الرقابية والمالية

The study aimed to identify the reality of the Jordanian municipalities between the application of the concept of local administration and the aspirations of local governance under the local administration law for the year 2021. To achieve the objective of the study, the analytical descriptive approach, as well as the Legal approach. The study reached a number of results, most notably: The municipalities are among the local administration bodies that follow the method of administrative decentralization to organize their areas and provide services to them, which is confirmed by the Jordanian Local Administration Law No. (22) of 2021. Although the Jordanian Local Administration Law of 2021 included many positive aspects related to expanding the powers of municipal councils, the law included a number of aspects and determinants to bring about a quantum leap in applying the concept of local governance especially in some legal, administrative and financial aspects. The study proposed some recommendations to enhance the role of municipalities in moving towards implementing the local government system in the future, the most prominent of which are: Making fundamental amendments in the provisions of the current Local Administration Law, by creating a more balanced relationship between the central and local authorities, that limits the control of the central authority and its control over the work of municipal councils, especially in the supervisory and financial aspects
