ضمانات الحق في الخصوصية في ضوء القانون الدولي والتشريع الأردني

Abstract

هدفت هذه الدراسة الموسومة بــ "ضمانات الحق في الخصوصية في ضوء القانون الدولي والتشريع الأردني"، إلى التعرف على ضمانات الحماية الدولية للحق في الخصوصية تقليدياً وفي الفضاء السيبراني، ومعايير الحق في الخصوصية في الفضاء السيبراني، وضمانات التشريعات الأردنية في حماية الحق في الخصوصية. ولتحقيق هذه الأهداف تم الاعتماد على منهجية وصفية تحليلية قانونية مقارنة. وقد توصلت الدراسة إلى أن مفهوم الحق في الخصوصية يشمل كافة جوانب الحياة الخاصة بالشخص والجوانب غير الظاهرة والعلنية من حياة الإنسان، وأن خصوصية الأفراد أصبحت في خطر ومهددة بالتعرض لها في ظل الثورة الرقمية، الأمر الذي أحدث تحولاً في التعامل مع الحق في الخصوصية، فأصبح يتضمن حق الشخص في التحكم في البيانات والمعلومات التي تخّصه ومنع الغير من إساءة استخدامها، مما أدى إلى تنبه المجتمع الدولي إلى هذه المخاطر، وتمت صياغة العديد من المواثيق التي تحقق التوازن الملائم بين الشواغل الأمنية الوطنية المشروعة والحق في الخصوصية. وقد حذا المشرع الأردني حذو المواثيق الدولية، وأبدى اهتماماً خاصاً بحماية حق الخصوصية، ويمكن الاستدلال على هذا الاهتمام من خلال نصوص الدستور الأردني، والعديد من التشريعات التي كان آخرها مشروع مسودة حماية البيانات الشخصية عام 2022، التي لم يتم المصادقة عليه إلى حين إعداد هذه الدراسة في العام 2023، وذلك في محاولة من قبل المشرع الأردني لمواكبة التطورات والجرائم التي تمس خصوصية الأفراد.

This study, titled "Guarantees of the Right to Privacy in light of International Law and Jordanian Legislation", aimed at identifying the guarantees of international protection of the right to privacy traditionally and in cyberspace, the criteria for the right to privacy in cyberspace, and the guarantees of Jordanian legislation in protecting the right to privacy. To achieve these goals, the descriptive analytical approach was relied upon. The study revealed that the concept of the right to privacy includes the core of a person's private life and the hidden and public aspects of human life, and that the privacy of individuals has become in danger and is threatened by exposure to it in light of the digital revolution; which caused a shift in dealing with the right to privacy, as it includes the right of a person to control the data and information that pertains to him and to prevent others from misusing them, which led to the international community alerting to these risks. Many charters have been drafted that strike an appropriate balance between legitimate national security concerns and the right to privacy. The Jordanian legislator followed the example of international conventions, and showed special interest in protecting the right to privacy, this interest can be inferred from the provisions of the Jordanian constitution, and many legislations, the latest of which was the draft personal data protection draft in 2022, which was not approved until the preparation of this study in the year 2023, in an attempt by the Jordanian legislator to keep abreast of developments and crimes committed affect the privacy of individuals.
